Terms of service

1. The service
Octo is a Discord bot configured through our dashboard. See getocto.gg for the current list of features — we keep improving Octo, so features can be added, changed or retired over time, and we cannot guarantee uninterrupted availability. The Free plan is offered without charge.
2. Who may use Octo
You must be allowed to use Discord under Discord's terms. Only server owners and members with the Administrator permission can change a server's settings. The server owner can restrict dashboard access for administrators at any time.
3. Your responsibilities
- You are responsible for how Octo is configured and used on your server, including every moderation action.
- You inform your members about the features you turn on, for example ticket transcripts or auto moderation.
- You do not use Octo for spam, harassment, raids, fraud or anything illegal, and you do not try to overload, reverse engineer or break Octo or bypass its limits.
- You follow Discord's Terms of Service and Community Guidelines.
We may remove Octo from servers or block users that violate these rules.
4. Paid plans and early access
The paid plans — OctoPlus, OctoPlus Pro and OctoPlus Custom — are monthly subscriptions per server and are listed on the pricing page. OctoPlus Custom (your own bot) is not available yet. Once available, plans will be sold and billed through Discord, so Discord's payment terms (including its refund policy) apply to the purchase.
Octo is currently in early access: every feature except the custom bot is available on every server for free, with no plan required. This is not a permanent entitlement — once paid plans launch, features and limits above what the Free plan offers will require a subscription. We will announce that at least 30 days before it takes effect. If a server is then using more than the Free plan allows, those settings are paused, not deleted, until the server subscribes or is brought back within the Free limits.
Once paid plans are live, you can cancel a subscription at any time; it stays active until the end of the paid period, after which the server returns to Free under the same pausing rule above. Features marked as "soon" are not yet part of any plan.
5. Liability
We are fully liable for intent and gross negligence, for injury to life, body or health and where mandatory law requires it (e.g. the German Product Liability Act). For slight negligence we are only liable for breaches of essential contractual obligations, limited to the damage typically foreseeable at the time the contract was concluded. Otherwise our liability is excluded. We are not responsible for actions taken on your server based on your configuration.
6. Ending the use
You can stop using Octo at any time by removing it from your server. What happens to the data then is described in the privacy policy. We may discontinue Octo or a plan with reasonable notice; paid periods already started will be refunded pro rata.
7. Changes to these terms
We may update these terms. For paid plans we announce material changes at least 30 days in advance; if you do not agree you can cancel before they take effect.
8. Governing law
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, mandatory consumer protection provisions of your country of residence remain unaffected.
